    Terms of Service

    Effective date: August 4, 2026

    These Terms of Service (“Terms”) govern your access to and use of the MedPharma mobile application, website (www.medpharma.care), and any services we offer through them (together, the “Services”). By creating an account or using the Services you confirm that you have read, understood, and agreed to be bound by these Terms.

    The Services are operated by Medpharma Alliance International Limited (“MedPharma”, “we”, “our”, “us”), a company registered in Ghana. If you do not agree with any part of these Terms, please do not use the Services.

    1.Eligibility

    You must be at least 18 years old, or the legal age of majority in your country of residence, to use the Services on your own behalf. Persons under 18 may only use the Services through a parent or legal guardian who has accepted these Terms on their behalf.

    You agree to provide accurate, current, and complete information when registering and to keep that information up to date so we can deliver care safely.

    2.Your Account

    You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs on your account. Notify us immediately at customer@medpharma.care if you suspect unauthorised access.

    You may not share your account, sell your access, or use another person's credentials. We may suspend or terminate accounts that breach these Terms.

    3.Healthcare Disclaimer

    MedPharma facilitates access to licensed healthcare professionals, prescription fulfilment, diagnostic services, and AI-assisted health information. Healthcare providers are independently responsible for the medical care they provide through the platform; MedPharma facilitates access to care but does not itself provide direct medical treatment.

    AI-generated answers from Kobikuul are informational only and do not constitute a clinical diagnosis. Always speak with a qualified healthcare professional before acting on health information.

    The Services are not for emergencies. If you believe you are experiencing a medical emergency, call 112 or go to the nearest hospital immediately.

    4.Appointments, Prescriptions and Diagnostics

    When you book an appointment, request a prescription, or order diagnostic tests through the Services, you authorise the participating healthcare provider, pharmacy, or laboratory to deliver the requested service and to share the results with you through the app.

    Cancellations, reschedules, and refunds are governed by the policy displayed at the time of booking. Where you have paid in advance and the provider cannot deliver the service, we will work with the provider to refund or reschedule you.

    5.Payments

    You agree to pay all fees due for the services you request. Payments are processed by our partner gateways. We accept mobile money, credit and debit cards, bank transfers, and NHIS / insurance payments where applicable. You are responsible for any taxes, fees, or charges imposed by your bank or mobile network operator.

    MedPharma+ subscriptions

    MedPharma+ subscriptions auto-renew at the cadence displayed at sign-up. You may cancel a subscription at any time from MedPharma+ → Manage. Cancellation takes effect at the end of the current billing cycle.

    Refunds

    Refunds are handled on a case-by-case basis, generally for technical issues preventing service delivery, provider cancellations or no-shows, duplicate payments, or other circumstances at our discretion.

    6.Acceptable Use

    You agree not to:

    • Use the Services for any unlawful or unauthorised purpose;
    • Submit false, misleading, or fraudulent information;
    • Attempt to access another user's account or data;
    • Reverse-engineer, scrape, or interfere with the Services;
    • Upload content that is offensive, defamatory, or infringes someone else's rights;
    • Harass, threaten, or abuse other users or staff.

    We may remove content or restrict access for any user who violates this section.

    7.Intellectual Property

    The MedPharma name, logo, app, website, and all related intellectual property are owned by Medpharma Alliance International Limited or our licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services in accordance with these Terms.

    You retain ownership of content you upload (for example, prescription photos or your profile picture). You grant us a licence to store and process that content for the purpose of delivering the Services.

    8.Limitation of Liability

    To the fullest extent permitted by law, MedPharma is not liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability for any claim under these Terms is limited to the amount you paid to MedPharma in the twelve months preceding the claim.

    Nothing in these Terms excludes liability that cannot be excluded under Ghanaian law, including liability for death or personal injury caused by negligence.

    9.Termination

    You may stop using the Services at any time and may delete your account from Profile → Delete Account. We may retain certain information as required by law or for legitimate business purposes.

    We may suspend or terminate access if you breach these Terms, if we are required to do so by law, or if continued provision becomes commercially unviable. We will give reasonable notice unless an immediate suspension is necessary to protect you, other users, or our infrastructure.

    10.Changes to These Terms

    We may update these Terms from time to time. When we do, we will adjust the effective date above and, where the change is material, notify you in-app or by email. Continued use of the Services after the change takes effect counts as acceptance.

    11.Governing Law and Disputes

    These Terms are governed by the laws of the Republic of Ghana. Any dispute arising from these Terms will be resolved in the courts of Accra, except where mandatory consumer-protection laws give you the right to bring a claim in your local courts.

    We encourage you to contact us first to resolve any dispute. If we cannot resolve it through direct communication, we may agree to alternative dispute resolution such as mediation.
